Employee Rights upon Resignation: Explaining Article 85 of the Saudi Labor Law

Employee Rights upon Resignation: Explaining ArtiAccording to Article 85 of the Saudi Labor Law, an employee is entitled to a gratuity upon the termination of their employment due to resignation. In this context, the amount of the gratuity is determined based on the employee's length of service, where one-third of the gratuity is granted after a minimum of two consecutive years of service, not exceeding five years.

It is worth mentioning that if the employee's length of service exceeds five consecutive years but does not reach ten years, they are entitled to two-thirds of the gratuity. However, if the employee's service period reaches ten years or more, the gratuity is fully awarded to them.

This regulation aims to encourage job stability and motivate employees to continue their service, rewarding those who demonstrate loyalty and commitment to their work over extended periods with a gratuity proportional to their length of service.

Thus, this provision can be considered a significant measure to protect employee rights and incentivize commitment and continuity in employment, fostering job stability and contributing to enhanced trust and satisfaction in the workplace.CLE 85 of the Saudi Labor Law
