Understanding the Exceptions of Article 87 of the Saudi Labor Law

Within the framework of regulating the relationship between workers and employers, legal provisions play a significant role in defining the rights and duties of both parties. Among these provisions, Article 87 of the Saudi Labor Law stands out as an example of exceptions that require careful understanding and application.

The example mentioned in Article 87 exempts the full reward for the worker in certain cases. The first of these cases is when the worker leaves work due to a force majeure beyond their control. Here, the term "force majeure" comes into play, understood as circumstances or events that cannot be anticipated or prevented, compelling the worker to leave work without any other option. For example, force majeure may include natural disasters like floods or earthquakes, or unexpected incidents like fires or landslides.

It's worth noting that this exception protects the rights of workers in emergencies that surpass human control, making it important to ensure justice and fairness in the work environment.

The second exception mentioned in the article relates to cases where the female worker resigns due to specific personal events. If the contract ends within six months of her marriage date or three months of her childbirth, the female worker is entitled to the full reward.

This highlights the role of the law in protecting the rights of female workers during sensitive life stages, such as marriage or pregnancy and childbirth. This reflects the commitment to providing a supportive and encouraging work environment for women, contributing to enhancing equality in employment opportunities and achieving sustainable development.

In summary, understanding Article 78 of the Saudi Labor Law requires a precise understanding of the cases in which the full reward for the worker is exempted. Proper application of these exceptions contributes to promoting justice and fairness in the workplace and ensuring the protection of the rights of all workers in line with the principles of social justice and human rights.
