🔴 Important Notices:
Employers must pay attention to the following points when electronically documenting employment contracts for their employees through the Qiwa platform:
1️⃣ The probation period must be explicitly stated in the employment contract for new employees, not exceeding 90 days (Article 53).
2️⃣ The employer reserves the right to terminate the contractual relationship during the probation period without the employee's consent, provided that the contract includes a clause granting this right. Consequently, the employee cannot terminate the contract during the probation period.
3️⃣ A specific compensation should be determined in the contract in case of unjustifiable termination by the establishment (Article 77). Failure to specify compensation in the contract may result in the establishment compensating the employee for the remaining contract wages.
4️⃣ The employer may exclude commissions and variable sales percentages from the basis for end-of-service benefits, provided that the contract includes a clause to that effect (Article 86).
5️⃣ The employer may include a condition in the employment contract specifying the employee's workplace anywhere in the Kingdom or allowing the employer to transfer the employee from their original location to another location necessitated by work requirements.
6️⃣ If the nature of work allows the employee to know the employer's clients, the contract may include a clause prohibiting competition for a maximum period of two years after the end of the contractual relationship. This clause must be in writing, specifying the timing, location, and nature of the work (Article 83).
7️⃣ If the work entrusted to the employee allows access to trade secrets, the employer may stipulate that the employee must not disclose these secrets after the contract ends. This condition must be in writing, specifying the timing, location, and nature of the work.
8️⃣ Pay attention to the employee's start date when electronically documenting the contract through the Qiwa platform. The start date must be entered as stated in the employee's initial contract with the establishment.
9️⃣ Pay attention to the contract duration when electronically documenting contracts through the Qiwa platform. The duration should be written as is, regardless of the contract end date, as contracts are automatically renewed for an equivalent period, and the contract remains valid.
